建议选择方案一，并且在提出proposal of settlement同时，要求

撤销对FBI的提告，这样显得你很通情达理，更容易达成和解，即使政府律师仍然不同意，对法官也会有一个好印象。
方案二会失去和解机会，而且可能会导致法官对你的印象不好
