Want to file lawsuit against FBI and USCIS

My I-485 has been pending for more than 3 years because of FBI name check. Called 1-800 number several times. The response is the same everytime that my case is pending for name check.

My lawyer advised me to file a lawsuit against FBI and USCIS, but he does not provide such service.

I am going to file a lawsuit since there no other way. Anybody has any suggestions?
