140pending期间是否可以申请131？

我看了131的表，觉得即使目前是h1b身份也可以申请Reentry Permit啊，A reentry permit 。。。。or conditional resident to apply for admission to theUnited States upon return from abroad during the permit'svalidity,为何原因不能呢，请各位给指点指点，的确想回家看看。
