*H-1 cap, OPT6月到期，6-10月GAP怎么办！

刚工作，就赶上H-1B CAP截止申请。OPT6月到期，新的H-1申请要到10月才开始生效。请问：
1。是否4月1日交了新的申请，就可以合法居留？但不能工作？
2。6-10月的GAP， 如何有效处理？有否文件可以参考说服老板？
