When you apply for H1b, there is a question which you need to answer: Is the beneficiary of this petition a J-1 nonimmigrant alien who received a waiver of the two-year foreign residency requirement described in section 214 of the Act?

So, you have no choice.
I also know someone did get H1b without J-1 waiver. However, when he want to get GC, he was denied without J-1 waiver.

Also, you said about the J-1 visa is expired, but the obiligation is still existed.
