Although unemployment benefit or unemployment insurance is provided through State Labor department, it is insurance money. Your employer contirbutes the money to that pool, not the government. So claiming unemployment insurance doesn't mean you take any public welfare. So the mere fact that you ever claim unemployment benefit doesn't constistute a base for your 485 denial.

The only risk is some state labor departments may choose to notify INS of your loss of status when you file for the benefits and they find out you are on H1.
