is he still legal on H1?

my hu*****and came to USA as H4 two yers ago, after finding a job he transfered to H1B, but as he got serius injured three months ago, he didn't go to work till now, my question is should he change back to H4 now,or still can keep as H1, his company is holding the position for him and can take him back anytime he's able back to work.
Please help me us out!
