Help for AdvanceParole (H4)

I am a H-4 visa holder (Both I-140 and I-485 are pending, valid H4 to 2006). I plan to apply AdvanceParole (AP) and go back home this year. I learned from I-131 (Application form for Travel Document) that if you have valid H-4 and your I-485 is pending, you do not need to apply AP.

While my lawyer told me if I get AP and come back to US with AP, I have 1 year to stay in US and I have no chance to get H-4 again, then I have to leave. If I apply for H-4 visa in China when I come back, I have risk of being rejected.

What should I do? Thank you very much for your advice.
