my 140 NIW was denied 11/05 after RFE. our 485 deny notice came later soon. then my hu*****and EAD based on that 485 invalid right away. He go back china for H4 visa and came back again. I filed appeal for 140 Dec05, transfer to Washington DC Mar06 and still waiting for decision now. so appeal will take long long time you can't image what happened.
meantime, I filed 140NIW again myself Dec05, RFE again Feb06 and finally approve July 06. but unfortunately, still waiting visa number for file 485 again. and no EAD for my hu*****and for work for almost one year. If I could file EB1a, I will. but I will wait for decision of EB1a and then 485 file if Eb1a approve.

So my suggestion for you, File 140 NIW and EB1a or EB1b anything if possible. but since you no H1B. don't know how to do this.
