NIW appeal

Dear All

My NIW application was rejected by NSC last year. I appeal it and the case has been upending in AAO for several months. In this situation, I would like to another NIW application. I was told by my attorney that I cann't a new NIW before my case closed. However, someone, or some attorney told me that I can another NIW. This puzzled, who is right. I cann't find the related laws in the USCIS website. Does anyone have the same experience, or know the law about it? Please let me know. Thanks so much!
