I had a post here answering a similar question before. I hope that the girl follow my suggestion and did not file her application too soon. CIS is very strict with the DOL requirements. I saw quite a few direct denials in this regard including doctor's NIW 485 in the past around me.

you can file another I-140/485 if you meet the requirement set forth in the memo. Good Luck!
