please help: problem of gap between two H1Bs

在国家实验室，因fund问题需换工作到一个非营利组织作研究。旧工作到本月底结束，新工作的开始日期是10月中旬。旧的H1B status 一月到期，可以用现在的H1B在新单位工作吗？

如果不可以，在马上递交申请后是否可以在美国等待？这样的gap影响将来的485申请吗(140NIW 已批)？
