I do not know how he got H1 before waiver of J1. Normally, If somebody wants to get H1, he or she needs to get J1 waiver first. If he or she came in US with J1 visa by the support of Chinese support, it will be hard for him or her to get J1 waiver. If it is not, he or she can contact Chinese consulate.
