This is in response to your request for an advisory opinion as to wheather the exchange visitor is subject to the 2 year residence requirment.

Based on the IAP-66 data, it is the agency's determination that the exchange visitor is not subject to the requirement. It is not necessary to process a wavier on behalf of this exchange visitor.
