How to trun down candidate for PERM application?

After job posting, there are 2 potential candidates ted their resume. My manager turn down their applications with reason "Over-qualified". However, lawyer said that was a not a good reason for turn down the applicant.

Anyone have any idea/experiance how to deal with this case?
