is not current. then ur lawyer is right.

Ur spouse can't file 485 until the PD progresses.

Guess u lawyer handed in 140/485 in9/2005 to catch the last train before EB1/2 retrogressed.

wait until the PD becomes current. Then file 485 and 765 if needed.
