anyone who filed I-485 must have a legal status to be eligible to AOS when filing. otherwise cannot be granted AOS. section 245 of INA.
if 485 denied, file a MOR or an appeal, and at the same time file I-485 in order to compensate the gap for illegal status.
DAO may not like it as once you have a pending MOR, u have to wait for it be processed. knew a case like this. cousel had to suck up with the DAO in order to get the LPR.
