I94快过期了.请教

我的I94写的H1过期时间是8月30号,2006. 更糟糕的是,我刚被解雇了,公司会通知移民局停止我的H1身份. 所以我今天赶紧申请了H4身份,移民局可能明天会收到我的邮寄申请表.我估计在I94过期之前,我的H4还不会拿到批准.
那么,
1. 我可以在美国继续合法呆吗,等候其间,我是什么身份呢,
2. 还有,如果近期内我找到了新工作,我可以办理H1转换吗,以什么身份呢.
情况很复杂,急死我了,请各位提出建议.我提前感谢大家...
