Does pending I-140 allow me stay in US legally?

I just got J1 waiver and want to apply for H1B, but J1 will be expired on Sep. 30. I was told it would talk at least 6 months to have H1B. If my H1B can not be filed before Sep. 30, can I stay in US because I have a pending I140? Any same experiences or advices will be very appreciated.
