1. VOs in China are stricter than VOs in most countries. However, since you did get your waiver, it's also obvious you don't want to go back to China.
2. If you only want to keep status, not really want to get a master's degree, file with CIS within USA. You may need to ask new school whether they will wait till your F1 approval. You can stay during the pending period.
