I think you can claim them as your dependents if their stay meets the 183-day test. I don't think their visa status has anything to do with whether you can claim them as dependents or not. Check the IRS website for detailed info regarding how the 183 day test operates. I also don't think it will affect your GC application since if the tax law allows it you are simply following the law. It is my personal opinion.
