XiaoBaiTu: My brother-in-law's H1B expired?

My brother-in-law quit his job about 6 months ago. He got his H1b sponsored by his formal employer. I wonder if his H1b was expired since he had left his company? Now his wife got a I-140 (EB1) approval recently. They are going to submit their I-485 in July. Does my brother-in-law need a new H4 visa before they submit their I-485? Thanks so much!
