H-1b to J-1

I know it looks wierd. But I did meet such a situation. I accepted a postdoc offer from NIH and have to transfer from H-1b to J-1. My question is as follow: my H-1b contract ended by the end of 2003 and the NIH secretary did not file my documents yet. What shall I do? Is it possible to be driven out of US or is there any trouble for J-1 application?
