It all depends on the reason of the AOS denial.
I130/I140 revokation? fraud? .... or you are really takling about Immigration visa petition(I130,140,..) denial (with 485 concurrently filed)? All different subject categories in AAO. Some types even beyond AAO and require Judicial branch to decide.

US born person is US citizen (or can acquire US citizenship if not eligible for US citizenship at birth) regardless of the parents visa status.
