You can negotiate with them to see if new recipient would pay you back part or whole lawyer fee. I think new recipient would be happy to accept it if the certificate can be transferred sucessfully since it saves him/her a lot of time if eveything starts over.

You can talk to the lawyer and he/she may have some idea since they expect the new recipient to continue use their service for 140 and/485 submission.
