Your lawyer is correct. He should come up with a strategy to help you collect more relevant evidence to show you are superior to your peers.

"比如说LC影响雇主更换及collaboration" is absoultely not a good excuse since it has nothing to do with NIW.

Also do not use "your limited H1B status" as another excuse. It also has nothing to do with NIW.
