一个Advance Parole 和H1B的问题

请教：
我拿AP 回国然后入境后我的H1B 还有效吗？我的雇主说我的H1B status 是不变的。 但我的律师说我回来后身份变成parolee， 如果要变回H1 需要file一个extension 然后才能变回来。 有人知道到底是咋回事儿吗？
