You can for sure claim your daughter as a dependent no matter she 上没上DAYCARE . However, whether you can claim the exemption is completely depended on your AGI. Based on what you described, you have an option to file as header of household, and your hu*****and as married filling separately. I do not know if such an option will save you tax.
