You have bad luck because a picky officer can kill your EB1OR I-140 because you don't hold a tenured or tenure track professorship. AAO almost always uphold the officer's denial in this type of appeal cases. Only tenured professorship (such as assistant professor tenure-track) is bullet proof, all other university positions cannot really defend picky officers and AAO committes that interpret the statue narrowly.
