回复：485 denial

90% is kind of arbitrary. However, CIS will deny any single case they detect with such problem. They do not have a flexibility because law does not allow such a prctice. Now you have two options, 1) try your luck, 2) file another 485 when your PD is current and withdraw the current one. Under any circumstance, do not use any benefit such as EAD and AP from the current 485 and maintain your nonimmigrant status all the time.
