Q: I worked on H-1B briefly in a private company 3 years ago. When I lost my job I changed back to F-1. Now I found a new job with a company that will sponsor me an H-1B visa. Am I subject to the H-1B numerical cap?

A: No. You are exempted from the H-1B quota because you were counted against
the H-1B quota in the past 6 years.
