Am I a resident or non-resi. for tax purpose?

NIW140 已经批准, 485在排队. 到美国已经超过6年, 现在是H-1签证. 纳税/退税时算resident吗? 可以申请EIC (Earned Income Credit)吗?
好像在哪里看到/听到过-- 在美国待到5年以上, 纳税时就和resident一样, 不再填1040NR而是直接填1040. 那退税/申请credit是不是也和resident一样呢?
