J1 holder could stay at USA for three years several years ago. Your LG can apply for waiver at any time. His J1 status can't be changed to H1-b before you get waiver. Your LG can change job but still with J1.

It's easy to extend J1. If his boss like he can get the extension within one week. So, don't worry now.
