You can get your deposit back if your attorney really did not do any work for you, even if it is non-refundable. Otherwise, he/she can deduct the money according to the work she has done for your case, even if it is just the preparation. You can tell he/she that his/her withholding the money might violate the Professional Responsibilities and you reserve the right to report it the Bar Association.
