急：回国结婚问题

各位高人前辈： 小弟已递交I140（未批）， 485（未批）； AP已批，想回国结婚。
问：1）还没用过AP， LP可以签H4出来吗？
2） 如果用过AP， 雇主没换， 没使用EAD （仍然是H1）， LP可以签H4 吗？
