Because your part-time H1-B, you will be considered legal. The condition is that the orignal H-1 is not revoked. Under the regulations, however, a petitioner is supposed to promptly notify INS when the beneficiary is no longer employed by the petitioner. Obviously, the requirement is not mandatory. Negotiate with them.
