another question about my visa-please help!

I asked this question yesterday, and one friend replied. Thanks for the help. But I am still a little confused. My situation is: my hu*****and will transfer to O-1 this March,and the lawyer has just filed my application for O-3. Right now I am holding H-4. The lawyer said that the process might need to be several months. I want to know after my H-4 expires, and before my O-3 is approved, is it legal for me to stay in USA?
Please help.
