This is nothing to do with fraud and intent, or false merrage. Derivative case is similar to marriage case in that a merriage must exist at the time of approval. If at the interview, the citizen say "we are separated". I do not think the case can be approved without a halt. Fortunate, in citizen case, the spouse can file on her/his own a 360 to get the GC. For derivative case, no such relief.
