Yes, that is a big catch of H-1 Portability for those moving from uncapped case to capped case, which is not included in the H-1 portability provisions. An INS's clarification is needed on that. Attorneys won't believe a lower level CIS representative. We can not blame them. There were many emamples in the past, in which INS made mistakes, applicants took the consequence. At this point,I think that a clarification from CIS upper level is necessary.
