INS memo regarding H-1B portability. You can show it to your lawyer to see what is her comment.

I always think that H-1 portability is not contigent on a quota. As long as CIS takes your case, you can jump to the new company. At least CIS will take such case in April or even right now. However, if the company lawyer does not want to do it, you can not do it. Good Luck!
