NJ is different, I just got the reply from Rutgers graduate office, they said H visa holders can not get in-state tuition there and they are never considered in-state for tuition purposes because H visa defines you as a temporary, not a permanent, resident.
Temporary residents are not eligible for in-state tuition at the State
University of NJ
