Yes, you can apply by your self, while your spouse can also apply at the same time. Both of you should listed your spouse in your I-140.

However, only ONE I-485 allowed. For example, if you file I-140 and I-485 (485 always include all members in your family for immigration), your spouse can only file I-140, no I-485. If in this case, your spouse's I1-40 is arrpoved first, then he can switch his approve I-140 to the I-485 that was filed by you.
