go ahead to do your FP

Just go ahead and do your FP, meanwhile file another 140, suppose your denied one is NIW(EB2), file an EB1 like outstanding researcher-OR or extraodinary ability, do it ASAP. Also if you have hired a lawyer to do your denied 140, ask him/her to help you appeal to re-open your case.
