My hu*****and and I submitted 140/485 when I was F-1.Denied and submitted again.Now 140 approved and we apply 485/AP/EAD together.

I have got my AP and EAD.nO 485 due to RETROGRESSION.

We don't know the answer to your question but your lawyer maynot be right since I got my AP and EAD approved by USCIS after my 485 denial the first time.

BTW:I am still F-1 or ***** may say I am AOS.
