Using AP should have nothing

to do with your status. If your hubby's 140 is denied, you will be out of status, as J2, even if you haven't used the AP. On this point, your lawyer is right.

Howevr, he/she might underestimate the consequence of the possible 140 denial. So it is better for you to make clear that with your lawyer.
