1. If his J1 has been waived and already filed his I485, then he can legally stay in US during I485 pending. but unemployment status may affect his I485 result except that his application is EB1a category.

2. If his J1 has not been waived, he can't file I485.

3. If his J1 has been waived, and he hasn't file I485 yet, then he may not file I485 for several years(at least can't file now) due to retrogression.
