you can file 140. You can call CIS 1800 number to verify it. And then ask your company to contact CIS customer service for that information. You can also search www.uscis.gov to download 140 form. The requirement of filing 140 is there. Nothing mentioned cut-off date (or visa aviailability). I do not know if you can find official something explicitly stating the relationship of 140 and cut-off date. Good Luck
