As long as your priority date is one year before, you are ok.

The priority date is the date you submit LC (EB2 or EB3) , or the date you submit I140 (EB2 NIW or EB1). That is the reason AC21 mentions both LC and I140.

You can use this question to interview the lawyer. I do not believe Fan Law is good one based on his understanding of this question.
