I140 denied + AP Used, Can I

I'm H1B visa holder. If I used AP (NOT EAD) and my I140/I485 denied, can I switch to H1B status in USA (i.e., do not need to go back to China to apply for H1B visa)? If I can switch to H1B in USA, how many days do I permit to stay in USA to deal with such a swith?
