interim EAD after I140 RFE

I have filed my NIW I140/I485/I765 three months ago. About one month after the filing, I got I140 RFE. Now 90 days passed and I walked in the CIS local office to get my interim EAD card. But they said that since the I140 RFE, the I485 was on hold and they can't issue interim EAD for me. Is it fair? Any suggestions?
